Protecting Your Personal Information

Our Organisation is bound by the Information Privacy Act 2009.  
 

The IPA provides you the following protections:

  1. Collection Limitation: Real estate agents must only collect personal information that is necessary for their functions or activities. This means they cannot collect excessive or irrelevant personal information from clients.
  2. Use and Disclosure Limitation: Real estate agents are restricted in how they can use and disclose personal information. They can only use personal information for the purpose for which it was collected, unless an exception applies (such as consent from the individual or where required by law).
  3. Data Security: Real estate agents are required to take reasonable steps to protect the personal information they hold from misuse, interference, loss, unauthorized access, modification, or disclosure. This includes implementing appropriate security measures such as encryption, access controls, and staff training.
  4. Data Quality: Real estate agents must take reasonable steps to ensure that the personal information they collect is accurate, up-to-date, and complete. They may need to update personal information if it becomes outdated or inaccurate.
  5. Openness: Real estate agents must have a clearly expressed and up-to-date privacy policy that outlines how they manage personal information. This policy should be readily available to clients and provide information about the types of personal information collected, how it is used and disclosed, and how individuals can access and correct their information.
  6. Access and Correction: Clients have the right to access the personal information that real estate agents hold about them and request corrections if it is inaccurate, incomplete, or out-of-date. Real estate agents must respond to such requests within a reasonable timeframe.
  7. Unique Identifiers: Real estate agents are generally prohibited from adopting, using, or disclosing unique identifiers (such as government identifiers or driver's license numbers) except in certain limited circumstances.
  8. Transborder Data Flows: Real estate agents must ensure that any transfer of personal information outside of Queensland complies with the IPA. This may involve obtaining consent from the individual or ensuring that the receiving entity provides an equivalent level of privacy protection.
